  Truck Accidents

  Of the 6 million plus auto accidents every year in the United States, the National Highway Traffic Safety Administration (NHTSA) estimates 140,000 or so of these accidents involve large trucks or buses. The great majority of these involve injuries, many of which are very serious and far too many result in death. There are a great many causes for truck accidents. Many of the causes are no different than those for other car accidents such as speeding and driver inattention. Far too often they involve what is generally inexcusable conduct made much more so in the case of trucks such as talking on the phone and texting. However, there are other causes that though they are not unique to truck drivers, they certainly seem to play a more prominent role. These would include such causes as driver fatigue caused by unreasonably long or erratic work hours. They are too often related to drugs (both legal and illegal) to address that very fatigue most prominent of which include methamphetamine. If you or a loved one has been suffered serious personal injury or wrongful death in a car accident involving a truck or bus, it is important to seek legal guidance right away. These cases pose some very significant challenges, many of which involve flat dishonesty and evasiveness by some (not all) trucking companies. It is just as important that you keep an eye out for signs of abuse and neglect. Your loved ones are quite vulnerable which is why they are there to begin with. Unfortunately, they sometimes will not speak up for fear. Other times, they simply cannot speak up. Nursing home staff turns over pretty regularly. They are often under-trained, underpaid and overworked. It may very well be that a home that was apparently safe at the time of admission is no longer so due to changes in staff. Do not sign a mandatory arbitration agreement! These agreements are largely enforceable no matter how atrocious the abuse or neglect. They are rarely if ever in the patient’s best interests. And they are not required for admission. If you suspect abuse or neglect, don’t be shy about confronting the home’s administration. If this doesn’t work, then immediately contact Adult Protective Services for guidance on how to handle the issue and to best protect your loved one. In cases of serious abuse or neglect, it may be necessary to immediately relocate your loved one to another home. If your loved one has suffered serious harm or death, then you will probably want some answers. • Birth Injuries

  Injuries or harm to a newborn baby are a parent’s worst nightmare. These injuries are emotionally devastating. The family is often never the same. • Auto Accident Insurance Issues and Claims

  Even seemingly minor auto accidents can have disastrous consequences to the victims. This is never more so than when the insurance companies on either side are misbehaving. Unfortunately, bad behavior on the part of insurance companies sometimes seems more the norm than the exception. In fact, you may have rights on both sides of the insurance, yours and the other driver’s.   The recent Department of Justice report on the excessive and unnecessary use of force by the Albuquerque Police clearly shows what many have known for years.   VA and Military Medical Malpractice Claims

  It is estimated that up to 440,000 Americans die each year from preventable medical error. The VA and Military Hospital systems are by no means immune. In fact, judging my the news reports suggesting systemic medical negligence throughout both the VA hospital system and the military hospital system, it may be much more pronounced. There are a number of complexities involved with medical malpractice lawsuits against a VA or Military hospital or medical provider. These claims are governed by the Federal Tort Claims Act. The Federal Tort Claims Act has a number of deadlines, requirements and restrictions not present in medical malpractice lawsuits against private medical providers. In addition, the Feres doctrine applies to claims by active duty military against military medical providers. The Feres doctrine does not apply to medical malpractice claims by family members harmed by medical negligence at the hands of military medical providers. This means spouses and children are not limited by the Feres doctrine. However, the same Federal Tort Claims Act rules will apply. In short, these claims can be complicated and it is highly advisable to seek the guidance of an experienced medical malpractice attorney in the event that you or a loved one has suffered serious personal injury or wrongful death through the negligence of a VA or Military healthcare provider.

  Early Deadlines in Your New Mexico DWI Case

  There are a number of important early deadlines in your DWI case. Sometimes these will run before you have even met with an attorney. It is very important to address these immediately or risk forfeiting rights and defenses. There are numerous other deadlines that will come up during the course of your DWI case. However, these are the ones that are most frequently missed due to the absence of attorney guidance. Once you have an attorney, whether private or public defender, your attorney will take care of these pre-trial deadlines. Unfortunately, these deadlines will run very quickly before many have even thought about hiring an attorney. In addition, they will often run before a public defender has been appointed and the public defender will typically not address the first 2 deadlines anyway since they are civil (not criminal) in nature. There is no 5th Amendment right to counsel on civil matters. MVD License Revocation Hearing Request When you are arrested for DWI in New Mexico, your license is subject to revocation if your breath alcohol was over .08. You are entitled to a hearing upon request. However, there is 10 day deadline on the request. In short, you must submit the MVD Hearing Request form with a $25 fee within 10 day of your arrest. Failure to request the hearing within the deadline will result in automatic revocation of your license. Vehicle Seizure Hearing In Albuquerque, there are vehicle seizure laws. Other towns and cities throughout New Mexico have similar laws. This discussion applies only to Albuquerque. You should always consult with an attorney familiar with your locale. If your vehicle has been seized, it is very important to request a hearing or you risk automatic forfeiture of your vehicle. Like the MVD License Revocation hearing, there is a short 10 day deadline on the Vehicle Seizure Hearing. Also like the MVD License Revocation hearing, a fee is required. You must submit your request along with a $50 administrative fee within 10 days of your DWI arrest. Failure to meet the deadline will result in automatic forfeiture of your vehicle. Waiver of Arraignment If you hire an attorney, you may in most DWI cases be able to waive your appearance at the arraignment. This means that you do not have to attend the hearing. An attorney, may enter a Waiver of Appearance with the court on your behalf. In addition, the same form may and often does provide for the waiver of your appearance at all pre-trial hearings. This is very beneficial for most to avoid disruption of work and family responsibilities. A couple of caveats apply. Waiver of appearance is not possible without an attorney. It is important to get this filed as early as possible. There are some judges that will not accept them unless that are filed well in advance of the arraignment. Peremptory Recusal of the Judge The fact is that there are some judges that are better for these types of cases for a variety of reason which need not be discussed here. Once you have an attorney, they can discuss this issue with you. Together you can decide whether to recuse your judge. This means you get another judge on your case. The Peremptory Recusal must be filed within 10 days of the date of the arraignment or waiver of arraignment whichever occurs first. You only get one recusal. You cannot go judge shopping as they say. However, that one recusal may be very important and merits discussion with an experienced DWI attorney.

• Domestic Violence Charges

  Domestic violence charges are taken very seriously in New Mexico. If you have been charged with domestic violence, it is essential that you immediately seek the assistance of an attorney. If you cannot afford an attorney, there are many very capable public defenders that can assist you. Do not delay! There are a number of important deadlines that begin to run once domestic violence charges have been filed by the state. Missing these deadlines can jeopardize the defense of your charges. In addition to the issue of deadlines, there other equally important matters that will arise. The first will be the no-contact order prohibiting contact with the alleged victim. The no-contact order is put in place along with the conditions of release that will be issued at the time of your arraignment or first appearance. Violation of the no-contact order will not only lead to your arrest, it can result in additional criminal charges including felony charges. In addition to the no-contact order, there will be other conditions set while your case is pending. Some of these, like the no-contact order, can be quite burdensome. It is important to have the guidance of an attorney who will often be able to avoid some of the conditions. These cases can take time to resolve. It is extremely important that you abide by all conditions of release. The judge can order that you be taken into custody for violations. • No-Contact Orders in New Mexico Domestic Violence Cases

  When someone is charged with domestic violence in New Mexico, among the first thing that happens is the judge will order conditions of release. These conditions must be met or the defendant can and often is taken into custody (i.e. goes to jail). Among the most important and most frequently violated conditions is the no-contact order in domestic violence cases. The no-contact order prohibits any contact with the alleged victim. This prohibition applies to any contact whatsoever including physical, phone, emails, mail, social media, third party intervention, carrier pigeon or any other contact. The no-contact order is taken extremely seriously by the New Mexico courts. Sometimes it might seem like a bit much but domestic violence presents unique dangers for the alleged victims so New Mexico errs on the side of caution with blanket protection. Unless the condition has been lifted by order of the court, it is fully enforceable. This means it will and often is enforced even though the alleged victim invited and consented to the contact. In fact, this on occasion can be a very real danger to the freedom of the defendant where the alleged victim entices contact for the very purpose of violating the defendant’s no-contact order. No kidding, it happens! In short, if you and your significant other want to allow contact, you must go to court to have the no-contact order lifted. This means both you and your significant other must go to court. The judge and the prosecutor will want to know there is no safety risk. The judge will question and caution both parties regarding the change and only if the judge is convinced that the change is safe to the alleged victim will it be issued. Sometimes, the judge will refuse despite the wishes of the alleged victim. There are a number of reasons this might happen. The history of domestic violence of the defendant will be seriously considered. Alcohol and drug use will be considered. And there are some judges that simply will not allow it. In any event, if you have a no-contact order, do not violate it. Don’t assume that because your significant other has invited you over for dinner or anything else, that this will excuse a violating. The court order controls, not the wishes of the parties no matter how innocent those may be. If you want to change the order, talk to your lawyer and do it properly. If you decide to do it on your own with the consent of the other party, it may be that nothing ever comes of it, and it may be that you land in jail. No matter what you decide, you should fully understand the risks.

• Patient Rights to Safe Medicine

  Medical cannabis has proven to be highly effective and safe for New Mexico medical cannabis patients. Not only is it safe and effective in its own right, it is often an alternative to potentially highly addictive and dangerous pharmaceutical drugs used for the same medical conditions. Much of the opposition to medical cannabis, and cannabis generally, is based upon the myth of marijuana as a gateway drug. Much of this grew out of "reefer madness" which continues today. In fact, there is substantial evidence from numerous prestigious medical journals dispelling this myth. By contrast, there is no dispute that pharmaceutical pain killers and anti-anxiety medications are both highly addictive and potentially very dangerous. These numbers do not come from marijuana enthusiasts. They come from the CDC. For example, the 2013 numbers on deaths from pharmaceutical opiates from CDC estimated the deaths for 2013 at 16,235. The CDC estimated that in 2011 benzodiazepines were also present in 31% of opiate related deaths. Contrast this with the fact that there has never been a single documented death by an overdose on marijuana, and certainly not medical cannabis, Patients have a right to safe medicine.
